Daniel H. Crow
Since 2006, Dan Crow has advocated for owners, construction managers and contractors in all aspects of design and construction. Dan has litigated numerous complex, multi-party construction cases in state and federal courts, arbitration, mediation and dispute resolution boards. His experience encompasses claims for breach of contract, fraud, adjacent property issues, delay damages, impact and loss of productivity claims, construction defect claims, surety bond claims, contract termination-related claims, professional negligence claims, mechanic’s lien claims and breaches of the N.Y. Lien Law trust provisions.
Dan’s wide experience informs the firm’s transactional practice, where Dan represents owners in preparing and negotiating contracts. He regularly advises clients in getting troubled projects back on track.
Selected Experience:
- Obtained defense verdict after jury trial of contractor’s $2.5 million breach of contract claim against a school district in Westchester County
- Obtained a favorable settlement, at the brink of jury trial, for a construction manager suing a developer for Lien Law trust violations while the developer sought extensive damages for alleged construction defects
- Obtained a favorable settlement, at the brink of jury trial, for a school district being sued by a contractor for over $1 million in delay damages
- Obtained summary judgment dismissing alleged $30 million fraud claims against principals of construction management company; affirmed on appeal
- Litigated and obtained favorable settlement for hotel owner claiming damages for architectural malpractice
- Obtained summary judgment for construction manager, dismissing subcontractor’s $8 million claim for delay/impact damages
- Obtained summary judgment against developer that had diverted over $14 million in Lien Law trust funds
- Revamped design and construction master service agreements for New York City-area university
- Helped construction manager recover its claim in full, plus interest (over $8 million), from bankrupt owner, while closing out approximately 25 trade contractors alleging claims against the construction manager
- Negotiated countless design, construction and related contracts on behalf of public and private owners and contractors
